Service Agreement

1. Acceptance of This Agreement

Welcome to NDFriends. This Service Agreement ("Agreement") governs your access to and use of the NDFriends mobile application, related services, and associated features (collectively, the "Services").

By creating an account, accessing, or using the Services, you agree to be bound by this Agreement and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 18 years old to use NDFriends.

By using the Services, you represent and warrant that:

• you are at least 18 years old;
• the information you provide is accurate and truthful;
• you are legally able to enter into this Agreement.

We may suspend or terminate any account that violates this section.

3. Description of the Services

NDFriends is a social app designed for autistic users and related communities. The Services may include, without limitation:

• account registration and profile creation;
• social profiles and profile browsing;
• private messaging, including text, image, and voice messages;
• chatrooms, including creating, joining, inviting users, removing users, or banning users where permitted;
• Mood Feeds, including posting, editing, deleting, and reporting content;
• safety tools such as blocking and reporting users or content;
• account settings and account deletion tools;
• Nest features, including meditation, Future Letters, and optional self-assessment tools.

We may modify, suspend, or discontinue any feature at any time.

4. Account Registration and Security

To use certain features, you must register for an account and provide required information, such as your email address, password, username, and date of birth.

You agree to:

• provide accurate, current, and complete information;
• keep your login credentials secure;
• be responsible for all activity under your account;
• notify us promptly if you believe your account has been accessed without authorization.

You may not transfer, sell, lend, or share your account with another person.

5. User Content

You may create, upload, send, receive, or share content through the Services, including profile information, messages, images, voice messages, chatroom posts, Mood Feeds, and Future Letters ("User Content").

You are solely responsible for your User Content and for the consequences of posting or sharing it.

By submitting User Content through the Services, you grant NDFriends a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, transmit, and process that content solely as necessary to operate, provide, maintain, improve, moderate, and protect the Services.

You represent and warrant that:

• you own or have the necessary rights to your User Content;
• your User Content does not violate this Agreement, applicable law, or the rights of others.

6. Community Rules

You agree to use NDFriends respectfully and lawfully. You may not use the Services to:

• harass, threaten, bully, stalk, or intimidate any person;
• post or send hateful, abusive, discriminatory, or violent content;
• impersonate another person or misrepresent your identity;
• post false, deceptive, fraudulent, or misleading information;
• share another person's private or confidential information without permission;
• send spam, scams, or unauthorized promotions;
• upload viruses, malware, or harmful code;
• interfere with the operation or security of the Services;
• use the Services for unlawful purposes;
• exploit, harm, or target vulnerable users;
• post sexually exploitative, obscene, or otherwise inappropriate content;
• encourage self-harm, violence, or illegal acts;
• attempt to bypass restrictions, bans, blocks, or moderation actions.

We may remove content or take action against accounts that violate these rules.

7. Chatrooms, Messaging, and User Interactions

NDFriends may allow you to communicate with other users through private messages, chatrooms, Mood Feeds, and other interactive features.

You understand and agree that:

• other users are solely responsible for their own conduct and content;
• we do not guarantee the accuracy, safety, legality, or appropriateness of user-generated content;
• interactions with other users are at your own risk;
• we may, but are not obligated to, monitor, review, remove, or restrict content or behavior.

You may use available safety tools such as blocking or reporting users. We may investigate reports and take action at our discretion.

8. Moderation and Enforcement

We reserve the right, but not the obligation, to investigate, review, moderate, remove, restrict, suspend, or terminate content or accounts that we believe may:

• violate this Agreement;
• violate applicable law;
• create risk, liability, or harm to NDFriends, users, or third parties.

Moderation decisions may include:

• content removal;
• warning notices;
• temporary restrictions;
• account suspension;
• permanent account bans;
• chatroom-related enforcement actions.

Our decisions on moderation and enforcement are final except where applicable law requires otherwise.

10. Blocking, Reporting, and Safety Features

The Services may include tools that allow users to:

• block other users;
• report users, chatrooms, messages, or Mood Feeds;
• leave chatrooms;
• invite users, remove users, or ban users from chatrooms where applicable.

These tools are provided to help support safer interactions, but we do not guarantee that any action will fully prevent further interaction or harm.

11. Account Suspension and Termination

We may suspend, restrict, or terminate your account at any time, with or without notice, if:

• we believe you violated this Agreement;
• we believe your conduct creates risk or liability;
• required by law;
• necessary to protect the Services, users, or third parties.

You may stop using the Services at any time. You may also delete your account through the app settings.

If your account is terminated or deleted, your right to use the Services ends immediately.

12. Account Deletion

If you delete your account:

• your account will be deactivated promptly;
• your messages and related message content will be deleted;
• some records, backups, or logs may remain temporarily for up to 6 months as described in our Privacy Policy;
• certain information may be retained where legally required or reasonably necessary for security, fraud prevention, abuse prevention, dispute resolution, or policy enforcement.

13. Intellectual Property

The Services, including the app, software, design, trademarks, logos, graphics, interfaces, and all related content provided by NDFriends other than User Content, are owned by or licensed to NDFriends and are protected by applicable intellectual property laws.

Except as expressly permitted by us, you may not:

• copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Services;
• remove proprietary notices;
• use our name, branding, or content without permission.

14. AI-Assisted Features

Certain features may use AI-assisted tools to provide supportive or reflective content, including encouragement or wellness-oriented messaging.

You acknowledge and agree that:

• AI-generated outputs may be incomplete, inaccurate, or inappropriate;
• AI outputs are not medical, legal, or professional advice;
• you are responsible for how you interpret and use such outputs.

We may change, limit, or remove AI-assisted features at any time.

15. Third-Party Services

The Services may rely on or contain links to third-party services, technologies, or content. We are not responsible for third-party services or their acts, omissions, content, availability, or terms.

Your use of third-party services may be subject to their own terms and privacy policies.

16. No Warranty

To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, express or implied.

We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising out of course of dealing or usage of trade.

We do not warrant that:

• the Services will be uninterrupted, secure, or error-free;
• the Services will always be available;
• content will be accurate or reliable;
• any defects will be corrected.

17. Limitation of Liability

To the maximum extent permitted by law, NDFriends and its affiliates, service providers, licensors, and representatives shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of or inability to use the Services.

To the maximum extent permitted by law, our total liability for any claim relating to the Services shall not exceed USD $100 or the amount you paid us, if any, in the 12 months before the claim, whichever is greater.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

18. Indemnification

You agree to defend, indemnify, and hold harmless NDFriends and its affiliates, service providers, licensors, and representatives from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

• your use of the Services;
• your User Content;
• your violation of this Agreement;
• your violation of any law or the rights of another person.

19. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the United States and the State applicable to NDFriends' operations, without regard to conflict of law principles.

Any dispute arising out of or relating to this Agreement or the Services shall be resolved in the courts having appropriate jurisdiction in the applicable U.S. venue, unless otherwise required by law.

20. Changes to This Agreement

We may update this Agreement from time to time. When we do, we will revise the "Last updated" date above. If required by law, we will provide additional notice.

By continuing to use the Services after the updated Agreement becomes effective, you agree to the revised Agreement.
